Concerning the just announced FAA moratorium on new additions to the 51 percent approved list, I don't see Arion or the Lightning on the approved list. What does that mean, if anything to us who are currently in the process of building?

Hi Steve,
Probably nothing, however it is something to be concerned about because so much depends on your local FAA (FSDO) and their opinion as to what constitutes the 51% rule. And obviously with at least 22 of them flying, the airworthiness certificates are obviously being presented to the builders which means the FAA is happy with how each builder has been able to document that he did 51%. The current concern or problem came up with the introduction of factory assist programs for the very complex, high performance, (pressurized, turbo jet, etc) airplanes that had to be built at the factory. There is just no way that an individual builder was able to build something so complex at home and was not really doing any fabrication or work at the factory that came near accomplishing 51% of the processes to complete these types of airplanes. That is the FAA concern and the reason for the current situation.
At least the FAA once again has asked the EAA to be involved and as a result I believe that the best solution will be forthcoming. Lets hope so. Bottom line, I think the USA still has and will continue to have the best regulations for building and flying experimental aircraft.

Buz,

Thank you for your thoughtful and thorough response. You answered my questions and allayed my concerns. I was afraid that even though 20 or so Lightnings are flying in the USA that something had all of sudden changed that jeopardizes the rest of us, especially those in the builders’ assist program. I’m glad you could shed some light on a situation I didn’t understand. We should be thankful we have the EAA as our advocate and we live in the USA where we still have more aviation freedom than any other place on earth.
